Cette n\u00e9gociation vise la conclusion d\u2019un accord collectif ; \u00e0 d\u00e9faut, l\u2019employeur doit mettre en place un plan d\u2019action unilat\u00e9ral.<\/p>\n<p data-start=\"878\" data-end=\"954\">Apr\u00e8s r\u00e9alisation d\u2019un diagnostic, la n\u00e9gociation doit porter a minima sur :<\/p>\n<ul data-start=\"955\" data-end=\"1292\">\n<li data-start=\"955\" data-end=\"1029\">\n<p data-start=\"957\" data-end=\"1029\">le recrutement des salari\u00e9s exp\u00e9riment\u00e9s, en consid\u00e9ration de leur \u00e2ge ;<\/p>\n<\/li>\n<li data-start=\"1030\" data-end=\"1071\">\n<p data-start=\"1032\" data-end=\"1071\">le maintien dans l\u2019emploi des seniors ;<\/p>\n<\/li>\n<li data-start=\"1072\" data-end=\"1169\">\n<p data-start=\"1074\" data-end=\"1169\">l\u2019am\u00e9nagement des fins de carri\u00e8re, notamment via la retraite progressive ou le temps partiel ;<\/p>\n<\/li>\n<li data-start=\"1170\" data-end=\"1292\">\n<p data-start=\"1172\" data-end=\"1292\">la transmission des savoirs et des comp\u00e9tences, en particulier par le mentorat, le tutorat ou le m\u00e9c\u00e9nat de comp\u00e9tences.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1294\" data-end=\"1640\">Cette obligation s\u2019applique tous les trois ans, ou tous les quatre ans en cas d\u2019accord de m\u00e9thode. En cas de non-respect, un malus pourra \u00eatre instaur\u00e9 sur les cotisations patronales d\u2019assurance vieillesse et d\u2019assurance veuvage, selon des modalit\u00e9s pr\u00e9cis\u00e9es par d\u00e9cret. L\u2019entretien professionnel devient l\u2019<strong data-start=\"1886\" data-end=\"1925\">entretien de parcours professionnel<\/strong>, afin de mieux accompagner les trajectoires professionnelles des salari\u00e9s.<\/p>\n<p data-start=\"2002\" data-end=\"2448\">L\u2019entretien doit \u00eatre organis\u00e9 au cours de la premi\u00e8re ann\u00e9e suivant l\u2019embauche, puis tous les quatre ans, avec un \u00e9tat r\u00e9capitulatif tous les huit ans. Son contenu est \u00e9largi et porte notamment sur les comp\u00e9tences mobilis\u00e9es, le parcours et les perspectives professionnelles, les besoins de formation, les souhaits d\u2019\u00e9volution ou de reconversion, ainsi que sur l\u2019utilisation du CPF, les abondements possibles de l\u2019employeur et le recours au CEP.<\/p>\n<p data-start=\"2450\" data-end=\"2888\">La r\u00e9forme maintient l\u2019obligation de proposer un entretien apr\u00e8s certaines absences (cong\u00e9 de maternit\u00e9, cong\u00e9 parental, cong\u00e9 de proche aidant, etc.), uniquement lorsque le salari\u00e9 n\u2019a pas b\u00e9n\u00e9fici\u00e9 d\u2019un entretien au cours des douze mois pr\u00e9c\u00e9dant sa reprise. De nouveaux entretiens doivent \u00e9galement \u00eatre organis\u00e9s \u00e0 l\u2019issue de la visite m\u00e9dicale de mi-carri\u00e8re (45 ans) et dans les deux ann\u00e9es pr\u00e9c\u00e9dant le 60\u1d49 anniversaire du salari\u00e9.<\/p>\n<p data-start=\"2890\" data-end=\"3249\">Les principes inchang\u00e9s demeurent : l\u2019entretien n\u2019est pas un entretien d\u2019\u00e9valuation, il doit \u00eatre formalis\u00e9 avec remise d\u2019un exemplaire au salari\u00e9, lequel doit \u00eatre inform\u00e9 de son existence d\u00e8s l\u2019embauche.
